On February 24, 2023, the High Court of Delhi, India ruled against granting an injunction on Ujoy Technology Private Limited to stop using of the term “Bolt” as its trademark. The request was launched by Bolt Technology OU, an Estonian company that offered electric ride-sharing services. Bolt argued that its extensive presence in the global market helped the “Bolt” trademark gain a significant and substantial reputation that extended to India through advertising and promotion. It also claimed that the local company had misled customers by using the trademark of a well-known international business. However, the court rejected the claims and ruled against the injunction. This ruling was a departure from previous similar cross-border reputation trademark disputes in India, where the courts had protected foreign brands even with limited or no presence in the local market. The ruling also raised some questions for Bolt Technology OU, including whether to challenge the verdict or pursue amicable options to secure its brand in India.
