In 2021, following accusations that social-media companies were censoring conservative viewpoints through actions like the suspension of President Donald Trump’s accounts after the January 6 United States Capitol attack, Florida and Texas passed separate laws restricting social-media companies’ ability to moderate platform content. NetChoice LLC (NetChoice), a trade association representing several large social-media companies, sued to block both laws, arguing they infringed on their members’ First Amendment rights. Following a split opinion between appellate courts in Texas and Florida, the Supreme Court took up the cases but ultimately remanded them to the lower courts for further scrutiny.
In 2024, with NetChoice’s members left in legal limbo concerning content moderation, NetChoice needed to decide 1) whether it should encourage members to adjust their moderation approaches ahead of future regulation, 2) how it could help members mitigate the risk involved in moderation, and 3) how it should address regulators' concerns about moderation. The decision would profoundly affect digital expression in the future.
